Welcome to Upsy Quiz! These Terms and Conditions ("Terms") govern your use of our mobile application ("App"). By accessing or using Upsy Quiz, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Use of the App
1.1 Eligibility: You must be at least 13 years old to use Upsy Quiz. By using the App, you represent and warrant that you meet this age requirement.
1.2 Account Registration: You may need to create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

2. Content
2.1 User-Generated Content: You may be able to submit, post, or share content, including quiz questions and profile information. You retain ownership of your content, but you grant Upsy Quiz a non-exclusive, royalty-free, worldwide license to use, reproduce, and display your content in connection with the App.
2.2 Prohibited Content: You agree not to post any content that is illegal, harmful, offensive, or infringes on the rights of others. Upsy Quiz reserves the right to remove any content that violates these Terms.
3. Intellectual Property
3.1 Ownership: Upsy Quiz and its content, features, and functionality are and will remain the exclusive property of Upsy Quiz and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.
3.2 Restrictions: You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as permitted by these Terms.
4. Purchases and Payments
4.1 In-App Purchases: Upsy Quiz may offer in-app purchases for certain features or content. All purchases are final and non-refundable, except as required by law.
4.2 Payment Information: If you make a purchase, you agree to provide accurate and complete payment information. You authorize Upsy Quiz to charge your payment method for any purchases made.
5. Termination
5.1 Termination by Upsy Quiz: We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason.
5.2 Termination by You: You may terminate your account at any time by contacting us at support@upsy.app. Upon termination, your right to use the App will cease immediately.
6. Disclaimer of Warranties
Upsy Quiz is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation or availability of the App, or the information, content, materials, or products included on the App.
7. Limitation of Liability
To the fullest extent permitted by law, Upsy Quiz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the App; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App; and/or (f) the defamatory, offensive, or illegal conduct of any third party.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Upsy Quiz operates, without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
